1. Purpose
These Terms of Service (hereinafter "Terms") govern access to and use of the Kudu™ platform, accessible via the mobile application and the kudu.cash website. By using our services, you accept these Terms in their entirety.
2. Description of services
Kudu™ is a fintech platform offering the following services:
- Money transfers — sending money to Africa via a network of verified agents with escrow (KuduSafe™)
- Digital tontines — community rotating savings, accessible from the diaspora
- Group funds — community collections for weddings, medical expenses, projects and events
- Offline payments — QR code payments in areas without internet access
- Digital wallets — crypto wallets (USDT, USDC, BTC) with user-custodial model
- Loyalty programme — rewards system (Bronze → Diamond) and referral programme
3. On-ramp and off-ramp
On-ramp (fiat-to-crypto conversion)
The conversion of fiat currencies to crypto-assets is provided by Transak, a third-party provider subject to its own terms of service and regulatory obligations. Kudu™ is not responsible for services provided by Transak.
Off-ramp (cash withdrawal in Africa)
Cash-out operations are carried out by the FIDITECH agent network, consisting of independent exchange bureaux operating in:
- Côte d'Ivoire
- Benin
- Democratic Republic of the Congo
These agents are independent operators and are not employees of Kudu™ or FIDITECH.
4. Eligibility and registration
- You must be at least 18 years old to use our services
- You must provide accurate and complete information during registration
- Identity verification (KYC) is required in accordance with applicable anti-money laundering (AML) regulations
- Kudu™ reserves the right to refuse or suspend any account that does not meet verification requirements
5. User responsibilities
- You are responsible for the confidentiality of your login credentials
- You agree not to use the services for any illegal purposes
- You are responsible for securing your private keys and digital assets (user-custodial model)
- You agree to immediately notify Kudu™ of any unauthorised use of your account
6. User-custodial asset model
Kudu™ operates a user-custodial model. This means:
- Kudu™ does not hold your funds or private keys
- Kudu™ cannot recover your assets if you lose your access keys
- Loss of your credentials or private keys may result in permanent loss of your assets
- Kudu™ disclaims all liability for losses resulting from user negligence in securing their access
7. Fees
Fees applicable to Kudu™ services are transparently displayed in the application before each transaction. Fees may vary depending on:
- The type of service used (transfer, tontine, group fund)
- The destination country
- The chosen withdrawal method
- Your loyalty level
The fee schedule is subject to change. Any changes will be communicated to users with reasonable notice.
8. Agent network
Agents in the FIDITECH network are independent exchange bureaux, not employees or agents of Kudu™. As such:
- Kudu™ connects the user with the agent through the platform
- The KuduSafe™ (escrow) mechanism protects funds during the transaction
- Kudu™ is not responsible for individual actions of agents outside the scope of the platform
9. Prohibited uses
It is strictly prohibited to use Kudu™ services for:
- Money laundering or terrorism financing
- Fraud, scams or any unlawful activity
- Manipulation of the loyalty or referral system
- Circumventing identity verification procedures
- Any activity contrary to applicable laws and regulations
10. Limitation of liability
To the extent permitted by applicable law:
- Kudu™ provides its services "as is" and does not guarantee uninterrupted availability
- Kudu™ is not responsible for losses resulting from crypto-asset volatility
- Kudu™ is not responsible for services provided by third parties (Transak, independent agents)
- Kudu™'s total liability is limited to the amount of fees collected for the relevant transaction
11. Governing law and jurisdiction
- Services provided by Alevia Nova Ltd (technology platform) are governed by English law. Disputes fall under the jurisdiction of the courts of England and Wales.
- Services provided by FIDITECH SAS (agent network) are governed by Ivorian law. Disputes fall under the jurisdiction of the courts of Abidjan.
Regulatory compliance
Kudu™ is committed to complying with applicable regulations in its operating territories:
- United Kingdom — FCA (payment services), ICO (data protection)
- WAEMU zone (Côte d'Ivoire, Benin) — BCEAO regulations
- Democratic Republic of the Congo — BCC regulations
- European Union — MiCA (crypto-assets), GDPR (personal data)
12. Dispute resolution
In case of a dispute, we encourage you to contact our customer service first at contact@kudu.cash. We commit to addressing your complaint within 30 business days.
Failing an amicable resolution, the dispute shall be submitted to the competent jurisdiction in accordance with Section 11 above.
13. Changes to these Terms
Kudu™ reserves the right to modify these Terms at any time. Users will be notified of any material changes by notification in the application or by email. Continued use of the services after notification constitutes acceptance of the modified Terms.
